The terms and conditions of our service
Introduction
This website and all material within it and its sub domains is owned, operated and property of Scoffable. By using Scoffable you agree to be bound by these terms, which take effect immediately on your first use of the website.
The following terms and conditions apply to all parts of this website. By accessing any part of the website the customer indicates that he/she agrees with these terms. The terms and conditions of this website do not affect your statutory rights as a consumer.
Online Payments
Scoffable is authorised to take payment directly from the buyer when they place an order, although the payment is taken by us rather than the restaurant itself, this does not change the fact that upon placing an order, a contract is formed between you “the buyer” and the restaurant “the vendor”. We facilitate the transaction and act as a mediator between parties.
We take payment from the buyer directly on behalf of registered vendors. Card details are not shared with the vendor and are processed by SagePay, an industry recognised payment processor. Your card details are not stored on our Servers.
Ordering Food
By placing an order the customer declares that all personal information provided by him/her is correct and accurate. Incorrect telephone numbers, addresses or e-mail addresses may lead to a delay or may even make the order impossible to be completed.
Scoffable has the right to cancel an order if the information provided by the customer is incorrect or incomplete. Scoffable and any restaurants or other third parties are under no legal obligation to meet any stated delivery time. Scoffable is obliged to transfer the order and all other information provided by the customer to the appropriate restaurant correctly and without delay. Scoffable is not responsible or liable if the restaurant does not manage to deliver the order in an appropriate time.
The customer has the right to cancel their order if they are a registered member they can do this from their account page by logging in; this can only be done if the order has not been already sent out by the takeaway to the specified address. If the user is not a registered member they can cancel by contacting the takeaway directly by the contact number provided in the confirmation e-mail.
Misuse of the Website
Scoffable has the right to refuse access to the website to anyone who misuses it. Furthermore, Scoffable will contact and co-operate in all possible ways to the appropriate authorities and take legal action if any crime is committed.
All IP Addresses are logged and if misuse in any form, internet service providers will be contacted and legal action taken.
Intellectual Property
Logos, names, images and trademarks on the website are proprietary rights of Scoffable. Users of this website are not allowed to print, copy, reproduce, transmit, or display any materials without our permission.
Access
Any person who accesses the website is considered a user of the website and a customer. We will try to keep the website available at all times; however we will not be liable for losses or damages caused by temporary unavailability of the website.
Scoffable is under no obligation to inform customers prior of pre-planned upgrades or improvements, which will make access to the website impossible for any periods of time. Although we will make sure that any planned upgrades are done at the most convenient of times to avoid any disruption.
All matters related to these terms and conditions or this website will be governed by Scottish law.

These Terms and Conditions last updated on the 17th of August 2009. Scoffable will try to keep the information in the website accurate and up to date at all times. However Scoffable will not be held liable if any information about the restaurants and their menus is incorrect or not up to date.
